#GSTAT Benches Have Been Reconstituted.
Does It Change Where You File Your #Appeal?
If you are planning to file an appeal before the #GSTAppellateTribunal, this is a development you should not overlook.
You may have already identified the appropriate Bench based on the earlier constitution. However, with effect from 𝟭 𝗔𝘂𝗴𝘂𝘀𝘁 𝟮𝟬𝟮𝟲, the GSTAT has reconstituted certain Benches and introduced a revised case classification framework. In some cases, this could change the Bench before which an appeal is to be filed.
The OBJECTIVE appears to be to improve administrative efficiency by distributing matters based on defined case categories and strengthening selected Benches.
𝗦𝗼𝗺𝗲 𝗼𝗳 𝘁𝗵𝗲 𝗸𝗲𝘆 𝗰𝗵𝗮𝗻𝗴𝗲𝘀 𝗶𝗻𝗰𝗹𝘂𝗱𝗲:
✔️ Reconstitution of Benches across multiple locations, including Chennai, Madurai, Delhi, Coimbatore, Puducherry and Lucknow.
✔️ Category-wise allocation of appeals to different Benches.
✔️ Bengaluru continues to follow a separate classification structure with an additional category.
✔️ Registries have been entrusted with the responsibility of classifying appeals based on the revised framework.
At first glance, this may seem like an ADMINISTRATIVE CHANGE.
In practice, however, identifying the correct Bench and the applicable case category is the first step towards ensuring that an appeal is instituted before the appropriate forum.
Sometimes, the success of #Litigation begins long before the first hearing. It begins with filing the appeal before the right Bench.
If you have appeals that are proposed to be filed on or after 1 August 2026, it would be worthwhile to verify the revised #Bench constitution and case categorisation before proceeding.
